1.1. These Terms and Conditions constitute a legally binding agreement between you (the “User”) and Banger Network sp.z.o.o. (which operates under the brand name of Axishift), Registration Number 0001047671 in Kalenska No. 5, Office 202, Post code 04-367, Warsaw, Poland.

1.2. By accessing and using the services provided by Axishift, you agree to be bound by these Terms and Conditions.

2.1. “Account” refers to the User’s account maintained with Axishift.

2.2. “Cryptocurrencies” refers to digital currencies and tokens.

2.3. “Services” refers to the services provided by Axishift, including the exchange and storage of cryptocurrencies.

3.1. Axishift offers various services related to cryptocurrencies, including but not limited to exchange, storage, and management of cryptocurrencies.

3.2. The User agrees to use the Services only for lawful purposes.

4.1. The User must be at least 18 years old to use the Services.

4.2. The User represents and warrants that they have the legal capacity to enter into this agreement.

5.1. To use the Services, the User must create an Account by providing accurate and complete information.

5.2. The User agrees to maintain and promptly update their information to keep it accurate and complete.

5.3. Axishift reserves the right to suspend or terminate the User’s Account if any information provided during the registration process or thereafter proves to be inaccurate, false, or misleading.

6.1. Axishift is committed to protecting the User’s privacy and handling their personal data in an open and transparent manner. For more information on how Axishift collects, stores, and uses personal data, please refer to our Privacy Policy.

7.1. The User agrees to use the Services in compliance with these Terms and Conditions and applicable laws.

7.2. The User is responsible for maintaining the confidentiality of their Account information, including their password.

8.1. The User agrees to pay any applicable fees for the Services provided by Axishift.

8.2. Axishift reserves the right to change its fee structure at any time. Any changes will be communicated to the User in advance.

9.1. The User is prohibited from engaging in the following activities:

* Money laundering, terrorist financing, or any other illegal activities.
* Using the Services to promote illegal goods or services.
* Attempting to gain unauthorized access to the Site or another User’s account.
* Engaging in any activity that interferes with or disrupts the Services.

10.1. Axishift will not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising out of or in connection with the User’s use of the Services.

10.2. Axishift total aggregate liability will not exceed the total amount paid by the User for the Services that are the subject of the cause of action.

11.1. The User agrees to indemnify and hold harmless Axishift and its officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses arising out of the User’s use of the Services or violation of these Terms and Conditions.

12.1. The User may terminate these Terms and Conditions and close their Account at any time, following the settlement of any pending transactions.

12.2. Axishift reserves the right to terminate the User’s access to the Services if the User violates these Terms and Conditions or engages in prohibited activities.

13.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Poland.

13.2. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Poland.

14.1. Axishift reserves the right to amend or modify these Terms and Conditions at any time by publishing the revised version on the Site.

14.2. The changes will become effective upon the User’s continued use of the Services after the publication of the revised Terms and Conditions.

15.1. Axishift will not be liable for any failure or delay in performing its obligations under these Terms and Conditions if such failure or delay is due to circumstances beyond its reasonable control.

16.1. Axishift reserves the right to send notices to and communicate with the User by any means of communication available, considering the contact details provided by the User.

16.2. The User agrees to receive notices in electronic form and to be bound by them.

17.1. All Services are provided “AS IS”, without guarantees of any kind, either expressed or implied.

17.2. Axishift will strive to keep the Site up and running but is not liable for any disruptions or losses the User may suffer as a result.

18.1. API requests are limited to 600 requests per 10 minutes.

18.2. Axishift may provide widgets and mobile applications, which are subject to these Terms and Conditions.

19.1. Axishift does not provide financial, investment, or legal advice in connection with the Services.

20.1. The User is responsible for paying all taxes and duties arising from the use of the Services.

21.1. The Site may contain links to third-party websites that are not owned or controlled by Axishift. Axishift is not responsible for the content, terms, conditions, privacy policies, or practices of any third-party websites.
